The petitioner would complain that the private respondents have carried out illegal construction by encroaching on the petitioner's property to the extent measuring 2 decimal out of 4 decimal lying and situated at Mouza Chaulisinghpur J.L No. 027 Khatian No. 1489, L.

According to the petitioner notwithstanding making repeated complaints, no steps have been taken by the municipal authorities. Last of such complaint has been made on 19th March, 2025.

Having heard the learned advocates appearing for the respective parties and noting the complaint as regards the illegal construction having been made, I am of the view that the municipal authorities should look into the

WPA 24334 of 2025 matter. Accordingly, I direct the municipal authorities to take a decision on the petitioner's complaint by carrying out an inspection if necessary, upon prior notice to the interested parties and if, the municipal authorities find that there has been any illegal construction, they shall act in accordance with law.

It is expected that a reasoned decision in this regard must be taken within a period of 12 weeks from the date of communication of this order. The decision must be communicated to the parties.

With the above observations and directions the writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities.
