CRIMINAL MISCELLANEOUS JURISDICTION CRM (A)/3463/2025 In Re: - An application for anticipatory bail under Section Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 arising out of Kashipur Police Station Case No. 36/2025 dated 14/04/2025 under Sections 61(2)/121(2)/191(2)/191(3)/190/221/224/121(1)/132/109/ 324(6)/326(f)/352/351(3) of BNS, 2023 read with Sections 8/9/15(A)/15(B) of the West Bengal Maintenance of Public Order Act and under Section 3 of the Prevention of Damage to Public Property Act.

1. Learned Counsel for the petitioners and the State are present.
2. Heard the submission of learned Counsel for the petitioners and considered the serious objection raised by learned State Counsel and also perused the materials on record.
3. From the materials on record it appears that the incident occurred due to an agitation and neither any sharp cutting weapon, nor explosive substances were used. The injury occurred due to mob violence.
4. Considering the materials on record, I find that this is a fit case for granting anticipatory bail to the petitioners.
5. Accordingly, in the event of arrest, the petitioners, namely, 1. KARIMUL MOLLA @ KARIEMUL MOLLA, 2. OHIDUL @ OHIDUL ISLAM,
3. SAMSUR @ SAMCHHUR MOLLA shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate at Baruipur, South 24-Parganas and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall appear before the learned Trial Court on each and every date of hearing and shall meet the Investigating Officer of this case once in a week for the next three months, until further orders.
6. In case the petitioners fail to adhere to any of the conditions stipulated above, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court.
7. The application for anticipatory bail being CRM (A)/3463/2025 is accordingly disposed of.
8. Criminal Section is directed to make available urgent photostat certified copies of this order to the parties, if applied for, upon compliance with all requisite formalities. (Apurba Sinha Ray, J.)
