During the course of submission it is transpired that charge sheet has already been filed.

Since the charges are yet to be filed let the petitioner filed an application for discharge before the learned Magistrate raising all the contentions in the same. 3.

Learned Trial Court shall decide the same in accordance with law after giving opportunities to the opposite party of being heard in accordance with law without giving any unnecessary adjournment.

Learned Trial Court shall also not be influenced by the order passed by this Court even court has not gone into the merits of the case and no expression made herein shall tantamount to be in expression on the merits of the case.

This petition is disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
