Mr. Sananda Bhattacharyya ....for the petitioner Ms. Chama Mookherjee, Mr. Gourav Das ...for the State Mr. Snehansu Majumder ...for the respondent no.6 The petitioner complains of alleged inaction on the part of the Dhantala Police Station, Ranaghat Police District, Nadia. The petitioner also complains that the private respondent is preventing her from effecting construction on her share of an undivided property.

Admittedly, T.S. No. 251 of 2019 is pending before the learned Civil Court, Ranaghat, Nadia. The Dhantala Police have taken steps under Sections 107 and 116 of the Cr. P.C.

Unless the property is appropriately demarcated between the petitioner and the private respondent, the patent and inter se rights cannot be ascertained.

The parties may approach the Civil Court for any final or interim relief in the pending civil suit.

There is no inaction on the part of the Dhantala Police.

The Dhantala Police Station shall, however, ensure that there is absolutely no breach of peace in the area and comply with any order that may be passed by the Civil Court on them.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
