Learned advocate appearing for the petitioner submits that the petitioner could not approach the learned Magistrate/trial court (sessions court in seisin of the matter) to comply with the order dated 05.04.2023 as there has been non-participation of the lawyers before the jurisdictional court.

Since the learned court could not exercise its powers and the directions passed by this Court, I direct that the directions so passed on 05.04.2023 by this Court be conducted by an appropriate officer of CID, West Bengal. The DIG, CID, West Bengal will appoint an officer of his choice and assess regarding the authenticity and genuineness of the Epic Card which has been relied upon by the petitioner. The concerned officer within two months from date will submit his report before the learned court in seisin of

Swarupnagar Police Station Case No. 539 of 2022 dated 26.05.2022. As there has been no change of circumstances, no interference is made with regard to the prayer for bail. The application for bail, being CRM (SB) 195 of 2023, is, thus, dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
