It appeared to the authority that the valuation of the flat along with the similarly situated flats were assessed as per rate fixed by the Mayor in Council dated October 29, 2008 where Rs.1.50/- sq.ft. rate was fixed for marble floor. In this case, as the floor was not marbled, the valuation of the flat was assessed at Rs.1/- per sq. ft. considering IPC/plain floor. This order was passed pursuant to the direction of this court. The court had directed the authority to dispose of the demand of justice.

The authority further opined that as there was no review committee under the Howrah Municipal Corporation Act, the applicant may approach the Commissioner for consideration of the matter. The documents have already been sent to the Commissioner.

shall dispose of the matter upon giving an opportunity of hearing to the applicant, within a period of three months from the date of communication of this order and a reasoned order shall be communicated to the applicant.
