1. This is an application for expeditious disposal of Ejectment Suit No. 235 of 2014 pending before the learned Judge, 4th Bench, Presidency Small Causes Court at Calcutta.

2. Record reveals that 8th June, 2022 was fixed for further cross-examination of P.W. 1. On 8th June, 2022, the plaintiff/petitioner herein filed an application for recalling the order dated 8th May, 2018 and another petition praying for taking off the matter from the PH Board.

3. It appears from the order sheets that several dates were fixed thereafter for hearing of the recalling application.

4. Learned advocate appearing for the petitioner submits that the recalling application is still pending.

5. Considering the fact that the recalling application is pending from June 2022, C.O. 3482 of 2023 is disposed of by requesting the learned Judge, 4th Bench, Presidency Small Causes Court at Calcutta to dispose of such application as expeditiously as possible but

preferably within a period of 12 weeks from the next date fixed. After disposal of such application, the learned Judge, 4th Bench, Presidency Small Causes Court at Calcutta is requested to dispose of the Ejectment Suit No. 235 of 2014 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

6. There shall be however, no order as to costs.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
