The revisional application has been preferred for quashing the Misc. Execution Case No.32 of 2010 which arises out of Misc. Case No. 388 of 2007 under Section 125 of the Code of Criminal Procedure. The grievance of the present petitioner is in respect of the distress warrant issued on 3rd June, 2013. Records of this revisional application reflect that on 5th August, 2013, when the revisional application was taken up, there was a direction to pay a sum of Rs.80,000/- to the wife-opposite party no.2 within a period of fifteen days. Today when the matter has been taken up, this Court has not been apprised as to whether there has been any compliance in respect of the order dated 5th August, 2013. Records also do not reflect any compliance being effected by the present petitioner.

Having regard to the same and the distress warrant being issued for non-payment of the award of maintenance, I am of the view that no interference is called for.

Accordingly, CRR 2741 of 2013 is dismissed.

All pending applications, if any, are consequently disposed of. Interim order, if any, is hereby vacated.
