The petitioners are all elected members of the Board of Directors of Sanghati Sangh Mahila S. S. Limited, a Cooperative Society functioning under the jurisdiction of village Bhabta, Beldanga, District-Murshidabad. All the members of the Board of Directors of the aforestated society are parties hereto.

The petitioner challenges the election to the post of office bearers from amongst the members of the Board, which has allegedly been held without any notice to the petitioners. Being aggrieved, the petitioners have preferred the present writ petition.

The petitioners are further aggrieved by the fact that their representation to the Deputy Registrar, who is the Returning Officer, was not considered at all and has been

ignored since, even though such grievance was ventilated in such representation.

The petitioner is directed to make a representation before the Election Commission, ventilating all of their grievances within a period of seven days from date. 5.

The Election Commissioner or his duly appointed/authorized representative (preferably the Returning Officer or Assistant Returning Officer of the concerned District), will consider such representation and upon hearing the parties, in the District concerned, will dispose of the same within a period of two weeks from the date of making the application.

6. The writ petition is, accordingly, disposed of. 7.

There shall, however, be no order as to costs.

8. Since no affidavit has been called for, the allegations contained in the petition are deemed to have been denied.

9. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
