Rejected that the petitioner is in custody for about 11 months and he was also arrested in connection with another case but he was released in the said case on bail. So far as the present case is concerned, according to the learned advocate, 39 witnesses have been cited by the prosecution in the charge-sheet and only one witness till date has been examined by the prosecution.

Learned advocate appearing for the State submits that in respect of other accused persons who were similarly situated, coordinate Benches of this Court have rejected the prayer for bail. State also submits that the petitioner along with others were involved in different types of cyber crimes. It has been specifically pointed out that from the account of the present petitioner, money trail of Rs.4.5 crores have been established and the total amount

involved in the case is around Rs.350 crores. Having considered that the trial has already commenced and the learned advocate appearing for the State submits that the number of witnesses have been reduced from 39 to 25 and all efforts would be taken to progress with the trial in the next two months, I direct that in case by 31st January, 2026 the evidence of 10 witnesses are not complete, learned trial court would release the petitioner on bail. At this stage, I am not inclined to release the petitioner on bail as an opportunity must be granted to the prosecution.

Consequently, CRM (M) 2139 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
