01.10.2024 SL No.21 Court No.29 (gc) (Allowed) CRM (A) 3495 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Laketown Police Station Case No.60 of 2019 dated 22.04.2019 under Sections 135 (1)(a) of the Indian Electricity Act.

1. In view of the fact that the petitioners have already deposited 50 percent of the final assessed sum and they are entitled to prefer a statutory appeal, we are of the view that custodial interrogation of the petitioners is not necessary.

2. Regard being had to the facts and submission, factum of permanent residence of the petitioner, nature of allegation and nature of offence, it is directed that the petitioners shall be released on bail in the event of their arrest by the learned Special Court under Electricity Act at Barasat, in the aforesaid P.S. case on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

3. The petitioners are directed to appear before the I.O within two weeks from today along with a server copy or certified copy of this order.

4. Accordingly, the prayer for anticipatory bail of the petitioners is allowed and the same is accordingly disposed of.

5. The learned Special Court under Electricity Act at Barasat is hereby directed to act upon the server copy of this order, if required.
