Report filed by the State is also taken on record. Learned advocate for the petitioner submits as follows. The petitioner is the owner of the land in question while the private respondents are neighbours, who are trying to grab the petitioner's property and raise an illegal construction. The private respondents committed several atrocities on the petitioner and his family members. The petitioner was compelled to lodge complaint before the police, but no effective steps have been taken.

Learned advocate for the State relies on the report and submits as follows. There are allegations and counter-allegations by both the sides. Proceedings have been initiated in this regard under Section 107 of the Code. On a complaint filed by the petitioner's side, a specific FIR had also been registered. The same is being investigated.

It appears that a dispute exists between the petitioner and the private respondents.

Several proceedings had to be initiated by both the sides. If any of the parties wants to establish any further right in respect of the property, the same is to be done before a civil court.

The police case registered shall be investigated expeditiously and in accordance with law.

The police shall keep a sharp vigil at the locale, ensure that no breach of peace takes place and to see that no order of a civil court is violated.

With these observations, the writ petition is disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
