The petitioner prays for consideration of its representation dated September 15, 2023 (Annexure P5, p.36).

Since none represents the port authority, Mr Jana, learned advocate who usually appears for the port, is directed to represent the port authority. His engagement be regularized by the concerned authority.

I have heard the submission made on behalf of the parties and perused the writ petition.

As it appears that the said representation is pending consideration before the port authority for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the fourth respondent - the Chief Engineer (InCharge), Kolkata Port Trust - to consider the petitioner's representation, after giving an opportunity of hearing to all the necessary parties, and dispose of the same by passing a reasoned decision in accordance with law at the

earliest but positively within eight weeks from the date of communication of this order. The decision once given shall be communicated to the petitioner immediately thereafter.

The petitioner shall forward a copy of the subject representation along with all supporting documents to the aforesaid respondent at the time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
