Kausik (Rejected) CRM (M) 2144 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baranagar PS Case No. 426/24 dated 18.10.2024 under Section 124(1) of BNS.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than a year and although charge sheet has been submitted and charge framed there has been no progress in the trial. Learned advocate submits that on any stringent condition the petitioner may be released on bail.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statements under Section 164 of the Code of Criminal Procedure. It has also been pointed out that the examination-inchief of PW 1 has been completed. Having considered the stage of the case, I am not inclined to release the petitioner on bail at this stage. However,

the learned Trial Court would put in efforts so that at least 5 witnesses are examined and completed by 31.01.2026. In case there is non-cooperation from the side of the accused, the learned Trial Court would record the same in the orders. The trial of the case would continue in spite of any resolution of the local Bar. If after such efforts the examination of 5 (five) witnesses are not over by 31.01.2026, learned Trial Court would leniently consider the bail application of the present petitioner.

Learned advocate for the State would communicate this order both to the learned Trial Court as well as the learned Public Prosecutor conducting the case.

Accordingly, CRM(M) 2144 of 2025 is dismissed at this stage.
