The petitioner's grievance is that the petitioner applied for holding a Durga Puja in the oncoming Durga Puja festival.

However, the respondent authorities have not responded to the same.

Learned counsel appearing for the State hands up an internal communication vide Memo No. 2347/BDO dated September 30, 2023 where it is indicated that the petitioner has not submitted any online application through the concerned web-portal, which is an essential pre-requisite for getting such permission.

It transpires from the annexures to the writ petition that the said apprehension of the State is correct, as only a hand-written representation was given by the petitioner. 5.

At this juncture, learned counsel for the petitioner hands over a print-out of a purported online application made by the petitioner subsequently, bearing Application Reference No. AFP/2023/00475.

Since such an application has now been made, WPA 23482 of 2023 is disposed of by directing the respondent authorities to consider the online application of the petitioner and take due decision on the same within three days from this date.

The learned Advocate for the petitioner shall hand over a copy of the print out filed in court today to his counterpart appearing for the State during the course of the day.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
