1. Mr. Shataroop Purkayastha, learned counsel for the appellant is heard on admission.

2. This intra-court appeal assails the order dated 06.08.2024 whereby the writ application was dismissed mainly on the ground of delay.

3. The case of the present appellant is that he was illegally detained by police authorities contrary to judgment of Supreme Court for four hours on 29.09.2018. He has suffered heart attack in July 2019 and after recovering filed petition on 29th July, 2021.

4. The learned Single Judge rejected the application on the ground of delay and opined that delay has not been property explained.

5. Despite repeated query, nothing could be pointed out to explain delay from 29.09.2018 till date of heart attack in July 2019. A bald pleading is there stating that the petitioner was seriously ill emanating from trauma of arrest that was caused due to such incident. However, no treatment

documents showing nature of ailments etc. have been filed. Thus, in our opinion, learned Single Judge has taken a plausible view which does not warrant interference. The intra-court appeal fails and is hereby dismissed.
