Petitioner is in custody for 99 days. He submits no narcotics was recovered from his possession. Co-accused including one Dipankar Saha has been enlarged on bail. He prays for bail on parity.

Learned lawyer for the State submits the vehicle was transferred and used by the petitioner and others. 3.

We have considered the materials on record. No documents showing lawful transfer of the vehicle to the petitioner and others have been placed on record. On such score co-accused have been enlarged on bail. Petitioner stands on same footing and may be extended similar benefit.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act Krishnagar Nadia on condition that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6.

The application being CRM (NDPS) 1550 of 2024 is disposed of.
