Mr. Amitabha Ghosh Ms. Nabamita Chatterjee ...for the petitioner Mr. Nilotpal Chatterjee Mr. Satyaki Banerjee ...for the Calcutta University Mr. Kallol Basu Mr. Suman Banerjee ...for the respondent no.8 The petitioner's case was that wrongly he was shown as absent in one of the papers of the examination which has reflected in his mark sheet but the college has admitted their mistake. Now, the college has sent the marks of the petitioner to the university. Now it is the duty of the university to issue a rectified mark sheet.

Learned advocate for the college has submitted that it is not only the mistake of the college, there was negligence on the part of the petitioner also. However, I am not entering into the matter.

I direct the Controller of the College to hold a meeting on 29th September, where any authorized representative of the college will be present with the papers required for issuance of a fresh mark sheet to the petitioner. The petitioner will also be

allowed to be present there along with his learned advocate, if he desires. In any event, the fresh mark sheet is to be handed over to the petitioner by the university directly as the time is very short. Since the petitioner has already taken admission in one college in Andhra Pradesh and has taken immigration certificate, it is to be given by 5th October, 2023. With this observation and direction, this matter is disposed of.

The HOD and the Teacher-in-Charge of Charuchandra College are present today in compliance with the order passed yesterday, their personal appearance is dispensed with.
