Mr. Bhagbat Chaudhuri Mr. Pranabendu Nath Moitra Ms. Paromita Moitra ... for the petitioners The grievance of the petitioner is that though the Commission work was completed pursuant to the order passed by the learned Judge, the learned advocate Commissioner has not yet filed the report. It appears from the order dated 26.06.2023 that 29.11.2023 was fixed for filing of Commissioner's report.

Learned counsel appearing for the petitioner submits that on 29.11.2023 also the Commissioner did not submit the report. Learned counsel appearing for the petitioner further submits that the next date has been fixed on 17.07.2024 for filing of such report. It will be open to the parties to approach the learned court below for preponing the next date of hearing and for filing of Commissioner's Report and if such an approach is made, the learned Civil Judge, Junior Division, 1st Court, Uluberia shall consider the same. The learned Judge is also requested to see that the Commissioner's report is filed within a reasonable time.

In the light of the above, the instant revisional application is disposed of. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties by speed post/registered post with acknowledgment due as well as upon the learned advocate representing the opposite parties in the learned court below.
