1. Heard learned advocates for the petitioner and for the State at length.

2. Perused the entire materials as placed before this Court including the materials as available in the case diary.

3. It is contended on behalf of the accused petitioner that in absence of any material to establish that any contraband was seized from his possession, the instant application for bail may be allowed.

4. Such prayer is opposed on behalf of the State by saying that the contraband was recovered from the house of the present accused petitioner.

5. On careful perusal of the entire materials, as placed before this Court, this Court finds no much prima facie material to establish that the alleged contraband was

recovered from the house of the present accused petitioner.

6. Considering such fact and considering the fact that the present accused petitioner is languishing in J/C for a considerable length of time and also keeping in mind that investigation has already been completed, this Court is inclined to allow the prayer for bail.

7. It is thus, ordered that the present accused petitioner may find bail of Rs. 30,000/- with two registered sureties of Rs. 15,000/- subject to the satisfaction of learned Chief Judicial Magistrate, Malda and also on condition that the present accused petitioner shall appear before the learned trial Court on each and every date of substantive hearing unless his personal appearance is exempted by the learned trial Court.

8. With the aforementioned observations, the application for bail is thus, disposed of.
