CRIMINAL MISCELLANEOUS JURISDICTION CRM (A)/3466/2025 In Re: - An application for anticipatory bail under Section Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mandermoni Police Station Case No. 97/2025 dated 25/07/2025 under Sections 140(2)/142/61(2) of BNS, 2023 read with Section 25(1-B)(a) of the Arms Act. And In the matter of: - AJOY BAGRA ...petitioner.

1. Learned Counsel for the petitioner and the State are present.

2. Having heard the submission of learned Counsel for the petitioner and taking into consideration the objection raised by learned State Counsel, I find that no Test Identification (T.I.) Parade was carried out. Further, the name of the petitioner transpired on the basis of a statement of a person calling the petitioner by his name.

3. In such view of the matter, I am inclined to allow the petitioner's prayer for anticipatory bail.

4. Accordingly, in the event of arrest, the petitioner, namely, AJOY BAGRA, shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of

like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate at Contai, Purba Medinipur and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall appear before the learned Trial Court on each and every date of hearing and shall meet the Investigating Officer of this case once in a week, until further orders.

5. In case the petitioner fails to adhere to any of the conditions stipulated above, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court.

6. The application for anticipatory bail being CRM (A)/3466/2025 is accordingly disposed of.

7. Criminal Section is directed to make available urgent photostat certified copies of this order to the parties, if applied for, upon compliance with all requisite formalities. (Apurba Sinha Ray, J.)
