15.01.2024 Srimanta Sl. No. 25 Ct. No. 655 CO/3366/2015 Tapan Kumar Bhattacharjee -Vs.- Santanu Mukherjee Both the parties are not represented.
The instant application is filed under Article 227 of the Constitution of India with a prayer for giving direction upon the learned Trial Court to dispose of the suit pending before it being T.S. No. 528/2006 within a certain date.
It appears that the plaintiff/opposite party filed the above suit by stating that the defendant no. 1 and her sons and agents have no right to forcibly and illegally evict the plaintiff from the suit property without recourse to law.
Although the parties are not present before this Court I find that if the Title Suit No. 528/2006 has not yet been disposed of, learned Trial Court will make endeavour to dispose of the said suit preferably within two months from the date of communication of this order.
Let a copy of this order be sent to the learned Trial Court for his communication.
Accordingly, the revisional application being CO/3366/2015 is hereby disposed of.
