The supplementary affidavit as filed today on behalf of the writ petitioner is taken on record.

At the time of hearing, Mr. Das, learned advocate appearing on behalf of the writ petitioner at the very outset draws attention of this Court to Page Nos. 66 to 69 of the instant writ petition, being copies of different orders as passed by the respondent no. 3/authority wherefrom it reveals that the respondent no. 3/authority came to a finding that a substantial portion of land in different plots have been utilized by the Irrigation and Waterways Department for construction of embankment without any knowledge of the Land Acquisition Department.

At this juncture, Mr. Das draws attention of this Court to Page No. 6 of the supplementary affidavit as filed today, being a copy of the memo dated 26.11.2024 as issued by the respondent no. 7/authority under cover of which the writ petitioner was requested to provide certain documents in order to enable him to pay compensation

on account of utilization of the land of the writ petitioner.

It is thus submitted on behalf of the writ petitioner that the respondent no. 3 and the respondent no. 7 authorities may be directed to take appropriate steps for immediate disbursement of compensation in favour of the writ petitioner in terms of the order dated 31.05.2023 as passed by the respondent no. 3/authority as well as in terms of the memo dated 26.11.2024 as issued by the respondent no. 7/authority.

Mr. De, learned Additional Government Pleader appearing on behalf of the respondent/State and its instrumentalities submits before this Court that the respondent no. 3 and 7 authorities may be directed to act in accordance with law subject to condition that the writ petitioner must provide the relevant documents to the respondent no. 7/authority as called for vide memo dated 26.11.2024.

At this juncture, Mr. Das submits before this Court that from Page No. 7 of the supplementary affidavit as filed today, it would reveal that all the documents as have been called for were deposited with the respondent no. 7/authority under cover of a letter dated 10.12.2024 which is disputed by Mr. De.

On careful perusal of the entire materials as placed before this Court and after hearing the learned advocates for the contending parties, this Court while disposing the instant writ petition directs the respondent nos. 3 and 7 authorities to disburse the

admissible amount of compensation to the writ petitioner within 120 working days from the day of submission of the relevant documents as called for vide memo dated 26.11.2024.

The time limit as fixed by this Court is mandatory and peremptory.

With the aforementioned observations, the instant writ petition being WPA 24592 of 2024 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
