The petitioner, stated to be the Secretary of a registered club, seeks for permission for a tubewell to be installed on the property of the petitioner club for supply of water to the adjacent school.

Learned advocate appearing for the municipality has produced a photograph from which it is seen that there is already a tubewell which is on the land of the petitioner club and the school is functioning from the property of the club and there is already an existing water connection with overhead tank on its roof. The petitioner club has leased out its property to the school and if the petitioner club wants additional water connection or to enhance water supply then they have to approach the municipality by way of a

separate application and only upon payment of requisite charges such application will be considered by the municipality in accordance with relevant regulation.

Therefore, the direction sought for in the writ petition cannot be granted and liberty is granted to the petitioner to approach the municipality if he so desires.
