In the order dated 17th January, 2023 it was made clear that in the absence of State counsel on the adjourned date, orders shall be passed in the matter.
The CBI has clearly indicated that on 11th April, 2022 the petitioner was at the CBI Camp Office at Forest Guest House, Jhalda, Purulia.
Therefore, the substratum of the allegations against the petitioner of being present at the place of occurrence on the date and time stands negated. In that view of the matter, the FIR, in so far as the writ petitioner is concerned, shall stand quashed.
With the aforesaid observations, the writ petition shall stand disposed of.
There shall be no order as to costs.
