In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

This revisional application was preferred in respect of Miscellaneous Case No. 117 of 2009 under Section 125 of the Code of Criminal Procedure wherein by a judgement and order dated 01.07.2010, learned Additional Chief Judicial Magistrate, Durgapur was pleased to direct the present petitioner to pay maintenance at the rate of Rs.3000/- per month to the wife/opposite party no.2.

I have considered the judgement of the learned Magistrate and I find that the learned Magistrate has appreciated the evidence which has surfaced in course of the proceedings. So far as the amount of maintenance is concerned, learned court took into account the earnings of the husband and thereafter arrived at a conclusion awarding a sum of Rs.3000/- per month as maintenance. Having regard to the reasons so assigned by the learned Magistrate, I am of the opinion that no interference is called for. Accordingly, the revisional application being CRR 2950 of 2010 is dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
