Court No.6.

AB (Allowed) CRM (M) 1833 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Swarupnagar Police Station Case No.128 of 2025 Dated 05.03.2025 under Sections 126(2)/103(1)/304(2)/249/61(2)/ 310(3) of the B.N.S. 2023 And In the matter of : Fojlu Mondal ......Petitioner.

Mr. Sabir Ahmed, Mr. Litan Maitra, Mr. S. Sarkar ......for the Petitioner.

Mr. Arijit Ganguly, Ms. Sima Biswas ......for the State.

1.

Having heard the Learned Counsel for the petitioner and also taking into consideration the objection of the State Counsel, I am inclined to allow the prayer for bail of the petitioner on the ground, inter alia, that investigation is complete and there is no chance of an early conclusion of the trial since 54 witnesses are yet to be examined. Moreover, the petitioner stands on the same footing with another co-accused, who has been granted bail by this Court on 09.10.2025.

2.

Thus, the prayer for bail is allowed.

3.

Accordingly, the petitioner, namely Fojlu Mondal shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial

Magistrate, Basirhat, and on further conditions that he shall remain within the jurisdiction of the concerned Police Station and shall report to the Officer-in-Charge of the said Police Station once in a week until further orders.

4.

The petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever.

5.

In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner's bail in accordance with law without further reference to this Court.

6.

The application for bail is, accordingly, allowed. 7.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Apurba Sinha Ray, J.)
