Mr. Siva Prosad Ghose .... For Petitioners This is an application for expeditious hearing of Title Execution Case No.5 of 2013 pending before the learned 2nd Civil Judge (Senior Division) at Alipore. Learned advocate appearing for the petitioners submits that the petitioners have taken out an application under Order I Rule 10 of the Civil Procedure Code, 1908 for impleading the heirs of the deceased judgment-debtors and the said application is pending. He further submits that the next date for hearing of the said application along with other applications are fixed on 2nd March, 2024.

In view of the aforesaid, CO 3497 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division) at Alipore to take up all the pending applications including the application under Order I Rule 10 of the Code of Civil Procedure, 1908 expeditiously on the next date fixed i.e. on 2nd March, 2024 and to dispose of the same as expeditiously as possible, preferably within a period of six weeks from the next date fixed, without granting any unnecessary adjournments to either of the parties.
