Mr. Neel Chakraborty ... for the Petitioner Mr. Sumitava Chakraborty ... for the respondent no.2 Mr. Biswajit Ghosh, Mr. Soumya Nag ... for the respondent no.5 The instant application is filed under Section 397/401 read with Section 482 of the Code of Criminal Procedure, 1973/ Section 438/442 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for setting aside the impugned order dated 09.07.2024. The petitioner is aggrieved and dissatisfied with the order dated 9.7.2024 whereby, the learned Additional Chief Judicial Magistrate-I, Calcutta rejected the application of the petitioner filed under Section 156(3) of the Code of Criminal Procedure, to register the First Information Report against the opposite parties under Section 467/468/471/420/406/120B of the Indian Penal Code. Copy of the impugned orders are annexed with the application.
On perusal of the impugned orders, it is found that in terms of order no. 1, dated 10.11.2023, the Learned Additional Chief Judicial Magistrate-I, Calcutta, called for a police report from the concerned Officer-in-Charge. Subsequently, when the police report was filed, in terms of order dated 09.7.2024, the Learned Registrar rejected the application one of the ground being pendency of another complaint in the Court of the Learned Metropolitan Magistrate, 28th Court, Calcutta, for disposal. On perusal of the impugned order, I do not find any infirmity in the same; rather the same is reasoned and passed on the basis of materials on record. Therefore, the impugned order is not interfered into. Accordingly, the instant criminal revision being CRR 4189 of 2024 stands disposed of.
Department is directed to return the certified copy of this criminal revision .
