The petitioner has prayed for grant of electric connection at premises no. 58/2/2B, Raja Dinendra Street, Ground Floor, Kolkata - 700006, Police Station - Narkeldanga.

The learned counsel for the petitioner submits that the petitioner is a tenant with respect of the premises in question and has applied for grant of electric connection and has also paid the requisite security deposit and the fee to the CESC for grant of electric connection.

Learned counsel appearing for the CESC submits that CESC is ready and willing to supply the electric connection but the landlord who is the added respondent in the present case is objecting for grant of electric connection to the petitioner. He submits that if the direction is passed with the police protection, the

CESC will provide electric connection in the premises of the petitioner with the cost of the petitioner. 4.

In view of the submissions made by the learned counsel for the respective parties, the CESC is directed to provide electric connection in the premises of the petitioner. If the petitioner or the officials of the CESC found that there is any objection from the landlord i.e., the private respondent or her man, agent or servant, the petitioner shall approach the concerned police station for providing police assistance for obtaining electric connection and, if any, request is made by the petitioner for providing police assistance, the concerned In-Charge of the Police Station shall provide appropriate police assistance to the petitioner as well as the CESC Ltd. for providing electric connection in the premises of the petitioner.

It is also made clear that if there is any padlock in the existing supply possession and if the private respondent is not allowed to open the said padlock, the petitioner with the assistance of the police personnel shall break open the lock only for the purpose of taking electric connection in the premises of the petitioner and after getting the electric connection in the premises of the petitioner, the petitioner shall put new padlock in the said existing meter and the key shall be handed over to the private respondent. All the cost shall bear by the petitioner.

With the aforementioned observations, the instant writ petition being WPA 24350 of 2024 is disposed of. 7.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
