Office report indicates that Jiban Barui, the petitioner before this Court was an accused of NDPS Case No. 4 of 2006 arising out of NCB Crime No. 14/NCB/KOL/2006 under Section 21C and 29 of the NDPS Act, 1985 filed this revisional application under consideration for quashing of the proceeding as against him. The report reveals that administrative notice could not be served upon Jiban Barui, the petitioner, who passed away on 3rd of August, 2013.

In such circumstances, this revisional application does not merit any further consideration. Consequent upon the death of the petitioner the criminal proceeding by operation of law is abated. With this observation, this criminal revisional application is thus disposed of.
