Petitioner is in custody for one year and five months. He prays for bail on the ground of delay in trial. 2.

Learned Advocate for the State opposes the bail prayer. 3.

We have considered the materials on record. Status report is placed on record. From the status report, it appears charge is yet to be framed.

Keeping in mind the slow progress in the case and the considerable period of detention suffered by the petitioner, we are inclined to grant bail to the petitioner subject to conditions. 5.

Accordingly, the petitioner viz., Md. Danish shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Signed By : ALOK SETH High Court of Calcutta 13 th of November 2024 04:32:43 PM

Magistrate, Sealdah, 24-Paraganas, South subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition petitioner while on bail shall remain outside the jurisdiction of Entally Police Station and provide address where he shall presently reside to the Investigating Officer and the court below and shall report to the concerned Police Station once in a week until further orders.

In the event the petitioner fails to appear before the Trial Court without any justifiable cause, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
