Learned counsel for the petitioner contends that the petitioner's application for permission to hold Durga Puja this year has not been responded to by the respondent authorities.

Learned counsel for the State submits that as a matter of policy, the applications by new organizers for holding Durga Puja for the first time this year are not being entertained on the online web-portal.

However, there does not appear to be any justification for such general policy decision, which does not have any reasonable basis whatsoever.

Be that as it may, since it would be difficult to accommodate the petitioner's application on the online portal at this belated juncture, it would be appropriate and in consonance with law if the respondents consider the representation given by the petitioner manually on such score.

Accordingly, WPA 23532 of 2023 is disposed of by directing the respondent no. 3, the Sub-Divisional Officer, Kalyani to consider the representation/application of the petitioner annexed at page-16 of the writ petition and to convey his decision to the petitioner within October 16, 2023.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
