C.R.A.N.1 of 2023 is disposed of by taking up the application for anticipatory bail for consideration. Learned Senior Advocate appearing for the petitioner submits that, petitioner is entitled to file an application for anticipatory bail since, the process for proclamation is yet to be concluded. Moreover, the coordinate Bench called for a report from the jurisdictional Court with regard thereto. He points out that, police filed charge-sheet and therefore, custodial interrogation of the petitioner is not required. Police are

proceeding on the basis of the statement of the co-accused made while in custody.

Learned advocate appearing for the State draws the attention of the Court to the materials in the Case Dairy. He also draws the attention of the Court to the orders passed by the jurisdictional Court with regard to proclaimation proceeding.

The police case is dated March 14, 2020.

There is an issue of long absconsion of the petitioner. The police case dated March 14, 2020. Petitioner filed the application for anticipatory bail sometime on September 26, 2023. Materials in the Case Diary suggest that involvement of the petitioner in the incident.

Process for proclamation was initiated.

In view of the long absconsion and the materials in the Case Diary, we are unable to grant anticipatory bail to the petitioner.

CRM(A) 4471 of 2023 is rejected.
