(NDPS) 1219 of 2025 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure, 1973 read with Section 483 of the B.N.S.S., 2023 in connection with Raninagar Police Station Case No.255 of 2024 dated 28.04.2024 under Sections 21(c)/ 29 of the N.D.P.S. Act.

1. Heard learned advocates for the petitioner and for the State at length.

2. Perused the entire materials as placed before this Court including the materials as available in the case diary.

3. From the materials, as placed before this Court, it reveals that initially the present accused petitioner was enlarged on anticipatory bail by a Division Bench of this Court on condition that the petitioner shall appear before the jurisdictional Court and shall pray for regular bail within a period of four weeks.

4. It reveals that on account of non-compliance of such order, the present petitioner was apprehended and he was languishing in J/C since then. It is reported that investigation has already been completed.

5. In view of such, this Court considers that further detention of the present accused petitioner is not at all necessary.

6. Accordingly, prayer for bail is allowed.

7. It is thus, ordered that the present accused petitioner may find bail of Rs. 10,000/- with two registered sureties of Rs. 5,000/- each subject to the satisfaction of learned Additional Sessions Judge under NDPS Act, 2nd Court, Berhampore, Murshidabad on condition that the present accused petitioner shall appear before the learned Trial Court on 15.11.2025 i.e. on the date of consideration of charge and also on all subsequent dates of substantive hearing, failing which, the learned Trial Court is directed to take appropriate steps for apprehension of the present accused petitioner.

8. With the aforementioned observations, the application for bail is thus, disposed of.
