Learned advocate appearing for the petitioner submits that the petitioner is aged about 80 years and he has been falsely implicated in connection with the instant case. Petitioner is in custody for 51⁄2 months and in spite of charge-sheet having been submitted, charge has not been framed. The prosecution proposes to examine 16 witnesses in support of its case, as such, there is no scope of the trial being concluded in near future. Learned advocate appearing for the State opposes the prayer for bail, after drawing the attention of the Court to the statement of the victim under Section 164 of Cr.P.C. as well as the medical documents.

Having considered the same including the age of the present petitioner and the period of detention, I am of the view that

further detention of the petitioner is unwarranted. Accordingly, the prayer bail of the petitioner is allowed. The petitioner, namely, Ranjit Halder shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under POSCO Act, Tehatta, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court. The petitioner shall not leave the jurisdiction of the district of Nadia without prior permission of the learned special court. Accordingly, CRM (M) 1859 of 2025 is allowed. Report so submitted be kept with the record.
