Dipankar Roychowdhury @ Bulu & ORS. v. Sibasish Bera @ Swapan Bera
20.03.2024 Item No.41 Ct. No.655 S.A.
CO 3183 of 2012 Dipankar Roy Chowdhury @ Bulu & Ors.
-vs- Sibasish Bera @ Swapan Bera Mr. Suhrid Sur Ms. Shebatee Dutta Mr. Dipankar Ghosh Ms. Poulami Roy ...for the respondent Petitioners are not represented.
Mr. Suhrid Sur, learned advocate appearing on behalf of the opposite party is present.
It appears that the instant revisional application is filed under Article 227 of the Constitution of India challenging the impugned order dated 25th April, 2012 passed by the learned trial Court in connection with Title Suit No.65 of 2007. By passing the impugned order learned trial court decreed the suit filed by the plaintiff/opposite party under Section 6 of the Specific Relief Act.
Being aggrieved and dissatisfied with the impugned order, this revisional application is preferred at the behest of the petitioner/defendant. It further appears that the instant revisional application was earlier dismissed for default and it was restored with its original file and number after allowing application filed by the petitioner. It is presumably held that the present petitioners have lost interest to proceed with the case and as such there is no
justification to keep this revisional application alive in this list.
Accordingly, CO 3183 of 2012 is hereby dismissed for default Interim order, if any, stands vacated.
There shall be no order as to costs.
