Learned counsel for the private opposite party submits that all the original documents have been returned to the private opposite party by the petitioner in compliance with the order dated 11th March, 2025.
The private opposite party filed an application under Section 156(3) of the Code of Criminal Procedure alleging that the original documents were in custody of the petitioner who was holding the same illegally. By the order impugned dated 7th September, 2024 in C 1093 of 2024, learned Chief Judicial Magistrate, North 24 Parganas forwarded the said application to the Inspector in charge, Barasat Police Station to treat the same as an FIR. Since the grievance of the private opposite party as made out in the application under Section 156(3) of the Code, has been redressed, it is not necessary to treat the application as an FIR and proceed with the investigation of the same any longer.
In view of the above, the order dated 7th September, 2024 is quashed/set aside.
CRR 4199 of 2024 is disposed of.
