Report reflects that the petitioner was granted interim bail on 5th September, 2022. Learned Magistrate after granting interim bail was pleased to fix the next date on 19th September, 2022. On 19th September, 2022 after perusal of the Case Diary and other necessary documents, learned Magistrate was pleased to confirm the order granting bail. Subsequently, on 5th November, 2022 charge-sheet was also submitted before the Jurisdictional Court. In the report it has been, as such, contended that since the charge-sheet has been submitted the custody of the accused are no longer required. Having regard to the change of circumstances and the nature of the offences complained of, I am of the opinion that there is no scope for interfering with the order of bail which was passed on 5th September, 2022. However, the petitioner is granted liberty to approach the Learned Magistrate/Trial Court, in case in course of the trial the petitioner finds adverse conditions for pursuing the trial.
With the aforesaid observations, C.R.M.(SB) 262 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
