In the instant case charge sheet has been submitted against the petitioner under Sections 183/341/283 of the Indian Penal Code read with Section 18 of the West Bengal Highway Act, 1964.

Having heard the learned advocate for the petitioner and on careful perusal of the suo motu written complaint and other materials on record this Court is prima facie satisfied that there

is ingredient to proceed with the trial against the petitioner under Sections 143/341 of the Indian Penal Code and Section 18 of the West Bengal Highway Act, 1964. Therefore, the case under Section 283 of the Indian Penal Code against the petitioner is quashed.

The learned Magistrate is directed to proceed with the G.R. Case No.2163 of 2018 against the petitioner under Section 143/341 of the Indian Penal Code read with Section 18 of the West Bengal Highway Act, 1964 and take all endeavour to conclude the hearing of the instant criminal case within a period of ten months from the date of communication of this order. The instant revision is, thus, disposed of.
