Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 129 days and the investigation of the case has already been concluded. Additionally, it has been stated that the petitioner is innocent of the charges and on any stringent condition, the petitioner may be released on bail.

Learned advocate appearing for the State has produced the case diary.

I have perused the materials appearing in the case diary. Having considered the period of detention of the present petitioner, I am of the view that further detention of the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Prabitra Ghosh @ Pobitra Ghosh shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under POCSO Act, Nadia at Krishnagar.

If on bail, the petitioner shall, till the consideration of charges is over, meet with the Officer-in-Charge, Bhimpur Police Station or any officer deputed by him once in a fortnight.

Report submitted by the learned advocate appearing for the State be kept with the record.

Case diary be returned to learned advocate for the State.

The application for bail, being CRM (M) 1860 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
