The petitioner appeared in the Madhyamik Pariksha (Secondary Examination), 2023 conducted by the West Bengal Board of Secondary Education.
The petitioner has passed the said examination with "AA" Grade but was not satisfied with his marks in the subjects Bengali, Mathematics, Physical Science and History as such applied for scrutiny and on such exercise, his number in History was increased by 5. The petitioner then applied under the provision Right to Information Act, 2005 to get the copy of his answer scripts in those subjects.
The petitioner on August 07, 2023 had received the copy of the said answer scripts.
Thereafter, complaining that some of the answers in his answer scripts of the subjects Bengali and Mathematics are unmarked, on August 14, 2023 he applied before the Board for awarding marks against those unmarked answers. The grievance of the petitioner is that his said application could not attract the attention of the Board till date.
The petitioner applied for awarding of marks against the unmarked answers within the stipulated time as such deserves a response from the Board, keeping such application pending for a long time is not justified.
The Board is therefore directed to dispose of the said application and shall communicate its decision to the petitioner as expeditiously as possible preferably within a period of three weeks from the date of communication of this order. WPA 23558 of 2023 is thus disposed of with the above terms without any order as to costs.
Since no affidavit-in-opposition has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
