Heard learned counsels for the parties.

It appears that an order has been passed under Section 14 of the SARFAESI Act by the learned District Magistrate and Collector, Paschim Bardhaman. The petitioner claims that after the said order, a settlement was arrived at by and between the petitioner and private respondent and major portion of the due amount has been paid by the petitioner.

Learned counsel for the private respondent denies and disputes the said contention and submits that though a proposal was floated by the petitioner for settlement, the same was not accepted by the private respondent. In view of the fact that the matter pertains to the SARFAESI Act, the writ petition is not maintainable and the same is accordingly dismissed.

However, on prayer of the petitioner liberty is granted to approach the appropriate forum for redressal of his grievance.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
