The writ petitioner is aggrieved that his application for grant of permit for the auto rickshaw on the route from Dhaniakhali to Haripal, as was submitted on 20th December, 2019 has not yet been considered by the respondent no. 2.

Mr. Dilip Kumar Samanta, learned counsel appearing for the petitioner seeks that the same may immediately be considered by the Regional Transport Authority Board, Hooghly.

In this case the existing operators of the said route has filed an application for addition of party being CAN 1 of 2024.

To that extent, the petitioner has filed affidavit-inopposition challenging the objections raised by the existing operators, as to grant of permit to the petitioner, in the said route.

The Court finds it proper to dispose of this writ petition directing the respondent Regional Transport Authority Board, Hooghly to consider the application for grant of permit of the petitioner dated 20th December, 2019 and decide upon that by dint of a reasoned order.

In doing so, the said Board shall afford opportunity of hearing to the writ petitioner as well as the objector if any, and also decide about the maintainability of the objection as to the prayer for grant of permit by the petitioner.

The entire exercise as above shall be concluded by the Board within a period of eight weeks from the date of communication of copy of this order.

Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

10. This writ petition being WPA No. 24440 of 2024 is disposed of, along with the pending applications, if any.

11. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
