Chhandashri Maji Mr. Dulal Dey ..... for the Petitioners The order rejecting the application under Order 6 Rule 17 of the Civil Procedure Code, 1908 for amendment of the written statement is under challenger in this civil revisional application under Article 227 of the Constitution of India.

Learned advocate appearing for the petitioners submits that during the pendency of this civil revisional application the suit has been decreed by the judgment and decree dated 7th October, 2023. He further submits that challenging the said judgment and decree an appeal, being Title Appeal No.83 of 2023, has been filed before the learned Civil Judge, Senior Division at Chandernagore.

Since the suit has been disposed of in the meantime this instant application under Article 227 of the Constitution of India has become infructuous and the same is disposed of accordingly.

It is, however, made clear that the petitioners will be at liberty to take steps in accordance with law in Title Appeal No.83 of 2023.
