Ms. Sreyasree Choudhury ...for the petitioner Affidavit of service and notice dated 25th November, 2024 are filed on behalf of the petitioner and taken on record.

In spite of service of notice upon the learned advocate representing the State-respondents on 25th November, 2024, State-respondents are not represented.

Husband of the petitioner was an assistant teacher who died in harness on 13th August, 2016. After death of husband of the petitioner Pension Payment Order was issued on 2nd May, 2017 disbursing retiral dues in favour of the petitioner being widow. Due to revision of pay under ROPA 2019 revised Pension Payment Order was issued consolidating retiral dues on 1st April, 2022. Petitioner claims interest on revised gratuity as per revised Pension Payment Order due to delayed payment. Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on revised

gratuity as per revised Pension Payment Order from 14th February, 2020 till the date of release of gratuity in favour of the petitioner, within a period of 8 (eight) weeks from the date of communication of this order. Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
