In Re: CAN 1 of 2022 Sufficient grounds are available to explain the absence of the writ petitioner on 10.11.2022. The order dated 10.11.2022 is recalled. The writ petition is hence restored to its original file and number. Accordingly, CAN 1 of 2022 is allowed.

In Re.: WPA 21919 of 2019 The writ petitioner is aggrieved by alleged inaction on the part of the I.C., Ramnagar Police Station. It is submitted that on the complaint of the writ petitioner, the S.D.O. concerned had asked the I.C., Ramnagar Police Station to submit a report after conducting an inquiry.

The I.C., Ramnagar Police Station had caused inquiries and found the dispute between the petitioner and the private respondents with regard to the lease of a nursing home and taking back of certain machinery inside the nursing home, as purely civil in nature.

This Court has carefully considered the report of the Officer-in-Charge, Ramnagar Police Station, Purba Medinipur as also the transactions between the petitioner and the private respondents. The disputes are purely civil in nature.

In these circumstances, the NCR registered by the Ramnagar Police Station under Section 107 of the Cr.P.C. is in order and there is no inaction on their part. With the aforesaid observations, the writ petition is disposed of.

The report of the Officer-in-Charge, Ramnagar Police Station, Purba Medinipur is taken on record. There shall be no order as to costs.
