Re: C.R.M. (M) 1872 of 2025 Petitioner along with another was apprehended in connection with the present case after alleged recovery of two
pieces of 7 mm improvised, semi-automatic pistols each fitted with empty magazines, extra two pieces of magazines, ten rounds of ammunition and other articles. Consequent to which the case was registered.
Learned advocate appearing for the petitioner submits that prosecution has relied upon ten witnesses in order to prove its case. Till date, only one witness has been examined and the evidence of second witness is in progress. Petitioner is in custody for 1 year 3 months.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are eight criminal cases pending against the present petitioner. I find that except two cases which are under FICN and under NDPS Act, rest of the cases are under the Arms Act. Having regard to the antecedents of the present petitioner and the stage of the case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner viz. Pradip Mondal is rejected.
The application for bail, being CRM (M) 1872 of 2025, is, thus, dismissed.
Re: C.R.M. (M) 1858 of 2025 The charge-sheet in the present case reflects that there were recovery of arms and ammunitions from the present petitioner and there are certain antecedents which have been reflected and the petitioner has history of being convicted under the provisions of Sections 489B/489C of the Indian Penal Code.
Be that as it may, so far as the stage of the case is concerned, evidence has already commenced and the evidence of PW-2 is in progress. The list of witnesses in the charge-sheet reflects that ten witnesses have been relied upon. There are two eyewitnesses in the present case who are CSW-3 and CSW-4.
State is directed to rely upon the said witnesses on the next schedule after the evidence of the present witnesses is over.
Petitioner would be at liberty to approach this Court after the evidence of the eyewitnesses is completed. At this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner viz. Laltu Mondal is rejected.
Case diary be returned to learned advocate appearing for the State.
The application for bail, being CRM (M) 1858 of 2025, is, thus, dismissed.
