Affidavit of service filed in Court today is taken on record.

None represents the respondents.

The petitioner's application seeking transfer was initially returned on 18th July, 2022 on the ground that the petitioner did not fall within the 10% of the existing staff to be transferred.

The petitioner thereafter approached the District Inspector of Schools (S.E.), South 24-Parganas and vide communication dated 2nd September, 2022 the District Inspector of Schools (S.E.), South 24-Parganas requested the Head of the Institution to take necessary steps for disposal of the pending case on medical ground.

The petitioner alleges that no steps have been taken till date.

As it appears that the District Inspector of Schools (S.E.), South 24-Parganas already directed the Head of the Institution to consider the petitioner's prayer for transfer on medical ground way back in September 2022, accordingly, the Head of the
Institution is directed to take steps for consideration of the said application for transfer on medical ground in accordance with the guidelines of the State and take a decision in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order.

If the application of the petitioner is allowed, then necessary consequential steps to forward the application to the District Inspector of Schools (S.E.), South 24-Parganas shall be taken by the school authority.

The fate of the application of the petitioner shall be made known to him.

The writ petition stands disposed of.
10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
