Mr. Kushal Chatterjee Mr. Oishik Chatterjee Mr. Aveek Saha ....for the petitioner Mr. Srijan Nayak Mr. Ankit Sureka Mr. Biplob Das ....for the respondent nos.4 to 6 Mr. Harish Chandra Thakur ....for the respondent no.7 The grievance of the petitioner is that no steps have been taken for appointment of a Special Officer of the Cooperative Society.

Mr. Chatterjee, learned advocate for the petitioner submits that since no Special Officer has been appointed and the tenure of the Board stood expired long back, the flats in question cannot be registered in favour of the petitioner.

The learned advocate appears for the respondent no.7 and submits that a Special Officer has been appointed vide notification dated January 8, 2026. The copy of the notification filed by the learned advocate for the respondent no.7 is taken on record. A copy of such notification has been supplied to Mr. Chatterjee, learned advocate for the petitioner. Since the Special Officer has been appointed, this Court gives liberty to the petitioner to approach the

Special Officer for registration of the flats in question. If such an approach is made, the Special Officer shall consider such request and take steps in accordance with law.

With the above observations and directions the writ petition stands disposed of.

In case the Special Officer is of the opinion that the registration of the flats cannot be done in favour of the petitioner, reasons in support thereof shall have to be communicated to the petitioner within a period of 4 weeks from the date such approach is made by the petitioner to the Special Officer.

There will be no order as to costs.
